At approximately 3:00 a.m. on Saturday, October 9, 2021, Southwest Branch officers responded to the report of an assault with a weapon at a fast-food establishment in the area of 80 Avenue and 103 Street. A group of five males were standing at the drive-thru window when they were approached by a group of male suspects including Isiaha Cermak, 24, and Darrious Ellis, 21, who were waiting in the drive-thru line. Cermak allegedly approached the group and pointed a firearm at them and subsequently discharged the firearm only a few feet away from where the group was standing; no one was struck.
Moments later, Cermak, Ellis and an unidentified suspect allegedly assaulted two males from the other group and then fled the area in a vehicle. The two males were treated and transported to hospital with serious injuries from the unprovoked attack. The groups were not known to one another.
At approximately 3:20 a.m. on Saturday October 9, 2021, roughly twenty minutes after the first incident, Cermak pulled into the drive-thru at another fast-food establishment in the area of 96 Street and 165 Avenue. It was reported that Cermak ordered a significant amount of food and was directed to pull ahead as it would take some additional time to prepare, but he refused and remained at the order window. Cermak then allegedly retrieved a firearm from his vehicle and racked it in front of the employee.
After a lengthy investigation, Cermak is charged with discharging a firearm with intent (x5), use of a firearm in the commission of an offence, possession of a loaded or restricted firearm, unauthorized possession of a firearm in a vehicle, possession of a weapon dangerous to the public (x2), unauthorized possession of a prohibited / restricted weapon, careless use of a firearm, pointing a firearm (x7), possession of a firearm with the serial number defaced, assault and aggravated assault.
Ellis was charged with aggravated assault.
